Bridge damage due to KEC's negligence.
Komatsu America Corporation, Komatsu Equipment Company (KEC), and Modern Machinery Co., Inc., based in Rochester, Washington, are being sued by Environmental Transportation of Nevada, LLC (ETON) regarding contributory negligence related to the bridge damage on Interstate 5 in Washington State.
On July 20, 2016, a semi-truck carrying two Komatsu excavators collided with an overpass on Interstate 5 near Chehalis, Washington, causing significant structural damage.
The lawsuit claims that Modern Machinery, as an agent of Komatsu America, did not load the excavators in accordance with the proper shipping dimensions published by Komatsu.
KEC is accused of intentionally transmitting incorrect cargo information, leading to a series of events that resulted in the bridge damage on Interstate 5. According to ETON management, "If KEC had provided the correct height restrictions for this cargo, ETON would not have transported it."
