The export eligibility determination refers to the process of assessing whether a product falls under the goods and technologies regulated by the "Foreign Exchange and Foreign Trade Act (Foreign Exchange Act)" when exporting. If you export without this determination, it will be a violation of the Foreign Exchange Act, so caution is required. However, exports to regions other than those specified in Appendix 3 of the Export Trade Control Order are subject to catch-all regulations. ■ List Regulations List regulations refer to the categorization of items and technologies that require permission for export. If you are exporting items that fall under these regulations, you need permission from the Minister of Economy, Trade and Industry. ■ Catch-All Regulations Catch-all regulations apply to the export of items and the provision of technologies that do not fall under list regulations. These regulations are enforced based on the intended use and the nature of the end-user, particularly if there is a risk that they may be used for the development of weapons of mass destruction or conventional weapons. This regulation does not apply to countries classified as "white countries," such as the U.S., Canada, and EU member states, where export controls are strictly enforced. When exporting or providing technology to countries other than white countries, both the intended use and the end-user must be examined, and a notification and permission from the Minister of Economy, Trade and Industry are required to determine whether permission is necessary.
