[Course Overview] In recent years, as the importance of intellectual property has increased, there have been notable instances where the Pharmaceuticals and Medical Devices Act (PMDA) has impacted patent practices in the pharmaceutical field. As a result, there is a growing demand for the development of pharmaceutical patent strategies that take into account the practical aspects of the PMDA. Additionally, there is a noticeable trend of patent disputes in the pharmaceutical sector, leading to increased attention on patent linkage as a means to prevent patent infringement. Recently, there has been a call for the establishment of pharmaceutical patent strategies that consider patent linkage. In this lecture, we will organize the recent amendments to the PMDA from this perspective and explain new viewpoints on pharmaceutical patent strategies that take patent linkage into account, as well as discuss future challenges and countermeasures.
