Switching to a Hazardous Materials Permit after Exceeding the Designated Quantity
KH-06 | Fire Service Act | Exceeding the designated quantity
Once added materials or larger volumes exceed the designated quantity, a small-quantity notification is no longer enough. From temporary storage approval to the permit and discontinuation notice.
If hazardous materials handled under a small-quantity notification reach a combined multiple of 1.0 or more because of added materials or larger volumes, the notification alone no longer keeps you compliant. Hazardous materials at or above the designated quantity may be stored or handled only at a permitted manufacturing, storage or handling facility (Fire Service Act Article 10(1)). Continuing operations without noticing can lead to orders and penalties, not just remarks from the fire department. When you find the quantity exceeded, temporary storage or handling is possible for up to 10 days with the approval of the fire chief. During that time, prior consultation and the installation permit application proceed, and after the completion inspection a discontinuation notice for the small-quantity notification is filed. Our Class A Hazardous Materials Engineer recalculates the multiples, applies for temporary storage approval, handles prior consultation with the fire department, files the installation permit application and the discontinuation notice.
